Chapter 82. STREETS, SIDEWALKS AND OTHER PUBLIC PLACES |
Article II. EXCAVATIONS |
§ 82-53. Bond required.
Each applicant for an excavation permit shall be required to file a surety bond with the city planning office in an amount to be set from time to time by the city council. The required surety bond must be:
(1)
With good and sufficient surety approved by the city council;
(2)
Satisfactory to the city attorney in form and substance;
(3)
Conditioned upon the permittee's agreement to hold the city and its officers harmless against any claims, judgments or other costs arising from the negligently performed excavation and related work covered by the permit which injured persons or property; and
(4)
Conditioned upon the permittee's agreement to fill up and restore, as nearly as possible to its original condition, all openings and excavations made in the streets and to maintain the restoration for 24 months after the completion of the work. Settling of the surface within the 24 months shall be conclusive evidence of defective backfilling.
